Terms and Conditions of Temporal Site Access

1. DEFINITION OF ACCESS STATUS

The relationship between the Invitee and the Host (or their designated representative) is strictly defined as a “Limited Temporal Site Access” arrangement. This status is characterized by a discrete, non-recurring window of time intended solely for content creation and professional observation. Under no circumstances does this access constitute a tenancy, a lodging agreement, or a guest-host relationship involving overnight occupancy.

2. THE ACCESS WINDOW AND TEMPORAL BOUNDARIES

Access to the property is granted exclusively during the specific date and time intervals explicitly stated in the booking confirmation (the “Access Window”).

• Strict Adherence: The Invite must depart the premises no later than the expiration of the designated Access Window.
• No Extension: Any attempt to extend the presence within the property beyond the specified window without prior, written, and formal authorization constitutes a breach of these terms.

3. PROHIBITION OF OVERNIGHT OCCUPANCY AND RESIDENCY

The Invitee acknowledges and agrees to the following strict prohibitions:

• Non-Residential Designation: The premises are provided as a professional workspace/set, not as a place of rest or habitation.
• Prohibition of Sleeping/Overnight Stays: All forms of overnight occupancy—including but not limited to sleeping, resting, or establishing presence during nocturnal hours—are strictly prohibited.
• Personal Effects: The Invitee shall not utilize the premises for the storage of personal luggage, clothing, or any items that imply a prolonged or residential presence.

4. BEHAVIORAL CONSTRAINTS AND SITE CONDUCT

The Invitee is granted access to the property as a transient professional entity. Consequently:

• Unauthorized Personnel: Access is limited to the individual(s) specified in the booking. No secondary guests, even for short durations, are permitted without prior authorization.
• Functional Limitation: The use of the site is restricted to the activities described in the initial service agreement. Any deviation into domestic or residential behavior is a violation of this protocol.

5. BREACH AND REMEDIES

Failure to comply with any provision regarding the temporal boundaries or the non-residential status of the access will result in:

• Immediate Termination: Immediate revocation of all site access privileges.
• Expulsion: Mandatory and immediate departure from the premises upon discovery of a breach.
• Financial Liability: The Invitee shall be held liable for any costs incurred by the Host resulting from unauthorized occupancy, including but not limited to, professional cleaning fees, security intervention, or damages associated with the breach of the non-residential agreement.

6. ACKNOWLEDGMENT OF NON-TENANCY

By accepting access, the Invitee explicitly waives any claim to residential rights, guest status, or any legal standing that would permit overnight stay or extended occupancy under local landlord-tenant or hospitality laws. The Invitee acknowledges that their presence is purely functional, temporal, and strictly non-residential.

7. RELEASE OF LIABILITY, INDEMNIFICATION, AND HOLD HARMLESS

A. TOTAL RELEASE OF LIABILITY

The Invitee, on behalf of themselves, their heirs, executors, administrators, personal representatives, successors, and assigns, hereby IRREVOCABLY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE the Property Deed Owner, the Host/Event Organizer, the Licensee (entity granted site use), and the Technology Provider (including all digital infrastructure, platforms, and personnel), collectively referred to as the "Released Parties," from any and all liability, claims, demands, actions, or causes of action whatsoever, whether known or unknown, arising out of or related to the Invitee’s access to the premises. This release includes, but is not limited to, personal injury, death, property damage, or any other loss or damage caused by the negligence (whether active or passive) of the Released Parties.

B. INDEMNIFICATION AND DEFENSE

The Invitee agrees to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from and against any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities (including, without limitation, reasonable attorney’s fees and court costs) brought as a result of:

1. The Invitee’s breach of any provision within these Terms;
2. Any damage to the property or site occurring during the Access Window;
3. Any injury or loss sustained by the Invitee or their secondary personnel/agents during the period of access.

C. SCOPE OF RELEASE

This exculpatory mandate extends to all aspects of the "Temporal Site Access," regardless of whether such access is facilitated via digital platforms or physical presence. The Invitee acknowledges that they are accessing the site at their own risk and that the Released Parties have no duty of care beyond the structural integrity of the premises as defined by law.
